Brazil could cap gambling deposits at 80 BRL per month

Brazil is considering a nationwide monthly deposit cap of R$80 for fixed-odds betting. Bill PL 3765/2026 was introduced by Senator Camilo Santana and remains under consideration in the Senate. As of August 19, the bill was awaiting the appointment of a rapporteur in the Committee on Transparency, Governance, Oversight and Consumer Protection.

The proposed cap would apply across the entire licensed market, rather than separately to individual sportsbooks. Deposits made by the same bettor with different operators would therefore count towards a single monthly total.

Bettors could apply for higher limits

The R$80 figure would serve as the standard monthly limit. Bettors would be able to request a higher threshold by demonstrating sufficient financial capacity.

The proposed maximum would be 5% of the bettor’s verified monthly income. Brazil’s Ministry of Finance would be responsible for determining how income is assessed and how financial capacity is reviewed.

The proposal is intended to reduce the risk of excessive debt and strengthen consumer protection measures.

Operators would have to return excess deposits

The bill would impose a direct requirement on licensed operators: if a bettor deposits more than the permitted monthly limit, the excess amount would have to be returned.

The system would need to track deposits across multiple licensed operators rather than resetting the limit for each individual account. Winnings and funds returned to the bettor would not count towards the monthly deposit total.

That would require a market-wide mechanism capable of linking a bettor’s deposits across licensed platforms.

Bill remains under consideration

PL 3765/2026 was filed on July 16, 2026. It is currently being reviewed in the Senate’s Committee on Transparency, Governance, Oversight and Consumer Protection and is expected to move to the Economic Affairs Committee afterwards for a final committee-level decision.

Should the proposal pass, the new rules would take effect after the prescribed transition period.

The bill would therefore introduce a single monthly deposit ceiling across Brazil’s regulated gambling market, rather than separate limits at individual sportsbooks. Bettors with verified income could potentially qualify for a higher threshold.
