1. Subject of the Agreement

1.1. This Agreement is a legally binding contract between the Administration and the User governing the use of the Site. A User is any person who has lawfully accepted this Agreement.

1.2. The text of the Agreement is shown to the User during registration on the Site. The Agreement takes effect from the moment the User expresses agreement with its terms (by completing registration or by actually using the Site) and remains in force for the entire period of use of the Site.

1.3. The processing of the User’s personal data is governed by a separate Privacy Policy and Cookie Policy; to the extent not covered by this Agreement, their provisions apply.

2. Age Restrictions and User Representations

2.1. The Site is aimed at a professional audience in the affiliate marketing and iGaming industries. By using the Site, the User represents and warrants that they are at least 18 years old, or have reached the age at which they may lawfully enter into such agreements on their own in their jurisdiction.

2.2. The User warrants that: (a) they have the legal capacity to accept this Agreement; (b) they do not and will not use the Site through automated means (bots, scripts, scrapers) without the Administration’s written permission; (c) they use the Site only for lawful purposes; and (d) the information provided at registration is accurate.

2.3. If the User provides false, inaccurate, or incomplete information, the Administration may suspend or terminate the User’s account.

3. Disclaimer of Warranties and Limitation of Liability

3.1. The Site and all its Content are provided "as is" and "as available," without any warranties of accuracy, completeness, or timeliness, express or implied.

3.2. The Administration takes reasonable steps to remove inaccurate, offensive, false, or knowingly incomplete information from the Site; however, final responsibility for posted content rests with the persons who posted it.

3.3. The Administration does not guarantee that registered users are who they claim to be and is not liable for any harm caused by such users to other persons.

3.4. The User acknowledges and agrees that they may not bring claims against the Administration for failing to provide, or for providing incorrect, personal data at registration.

3.5. Under no circumstances shall the Administration be liable to the User or any third party for any direct or indirect damages, including lost profits, loss of data, or harm to business reputation, honor, or dignity, arising in connection with the use of the Site or materials posted on it.

3.6. The Administration’s total liability to the User on any grounds related to use of the Site is limited to the amount actually paid by the User to the Administration during the preceding six (6) months. Since access to the Site is provided free of charge, that amount is zero.

3.7. No Financial Advice. The information and materials published on the Site are provided for informational purposes only and do not constitute financial, investment, gambling, or other professional advice. The Administration does not provide individualized advice and does not guarantee any profit. The User makes decisions based on the information received at their own discretion and bears full responsibility for any resulting risks or losses.

4. Affiliate Materials, Advertising, and Third-Party Sites

4.1. The Site may contain reviews, ratings, links, and advertising materials relating to third-party companies and services, including in the iGaming vertical. The inclusion of such material does not imply a recommendation, endorsement, or any relationship between the Administration and the relevant third party unless expressly stated.

4.2. Links to third-party sites lead to resources not controlled by the Administration and governed by their own terms of use and privacy policies. The Administration is not responsible for the content, accuracy, legality, or practices of such third-party sites and bears no liability for any damage related to their use.

4.3. The Administration provides advertisers with space to place materials on the Site and has no other relationship with them beyond placing advertising. Including an advertising material does not mean it has been vetted or endorsed by the Administration.

5. The Administration Is Entitled To

5.1. Change the Site’s appearance, its Content, and the list of available features, and update or add scripts, software, and other elements on the Site at any time — without prior notice and without liability to the User.

5.2. Send the User email notifications related to the use of the Site.

5.3. Moderate, modify, or remove any Content that violates this Agreement, and temporarily or permanently restrict, suspend, or terminate the User’s access to the Site or its individual sections — with or without notice, at its sole discretion.

5.4. Require age verification or other data where necessary to comply with applicable law (including law governing advertising of products in the iGaming vertical).

8.5. Creating multiple accounts (duplicate registration). If detected, the Administration may block all such accounts without warning.

8.6. Uploading, posting, or otherwise distributing Content that is unlawful, insulting to other users or third parties, vulgar, obscene, or pornographic in nature, contains confidential or proprietary information, infringes third-party rights, is advertising in nature, contains threats, defamation, or discrediting information, is fraudulent, or promotes racial, religious, national hatred, or other forms of human rights violations.

8.7. Impersonating another user or person, or using another user’s username without permission.

8.8. Systematically scraping or harvesting data from the Site to build a collection, database, or catalog without the Administration’s written permission.

8.9. Taking any action that places an excessive load on the Site’s infrastructure or disrupts its normal operation.

9. User-Generated Content and License Granted

9.1. By posting a comment, review, rating, or other User-Generated Content, the User grants the Administration a non-exclusive, royalty-free license, valid for the entire period the material remains posted, to host, reproduce, display, moderate, edit (solely to remove prohibited material), and delete such content as part of operating the Site.

9.2. The User warrants that they are the author or rights holder of the posted User-Generated Content, or hold all rights necessary to post it, that such content does not infringe the rights of third parties (including copyright and the right to protection of honor and dignity), and does not contain statements about third parties that the User knows to be false.

9.3. The User bears full responsibility for their posted User-Generated Content. The Administration is not obligated, but is entitled, at its discretion, to review, edit, or remove any User-Generated Content at any time without prior notice.

10. Rights to Content Posted on the Site

10.1. All intellectual property used and published on the Site (other than User-Generated Content, rights to which remain with its author under Section 9), as well as the Site itself, are the property of their lawful rights holders and are protected by intellectual property law.

10.2. Such Content may not be copied, reworked, distributed, displayed in frames, published, downloaded, transmitted, sold, licensed, or otherwise used, in whole or in part, for any commercial purpose without the prior written consent of the rights holder, except as expressly permitted under this Agreement or applicable law.

10.3. Content may be used strictly for personal, non-commercial purposes, provided that all copyright notices, the author’s name, and the integrity of the work are preserved.

10.4. Materials owned by the hustlers.digital Administration may be freely reproduced in any media, on internet servers, or other platforms, without restriction on volume or duration, provided there is a direct link to the source https://hustlers.digital/. No prior consent from the Administration or the authors is required.

10.5. When quoting on internet resources, an active hyperlink to the original source is required at the end of the material. Reprints may not rework the original text; shortening or rearranging parts is permitted provided it does not distort the meaning of the material.

11. Indemnification

11.1. The User agrees to indemnify the Administration for any losses, expenses (including reasonable legal costs), and third-party claims arising from: (a) the User’s breach of this Agreement; (b) Content posted by the User; or (c) the User’s infringement of third-party rights, including intellectual property rights.

12. Third-Party Copyright Claims

12.1. The Administration respects the intellectual property rights of others. If a User or third party believes that material posted on the Site infringes their copyright, they must send a notice to [email protected] including: a description of the work, the location of the disputed material on the Site, the claimant’s contact details, and a good-faith statement regarding the claim.

12.2. Upon receiving a substantiated notice, the Administration may remove or restrict access to the disputed material. A person who submits a knowingly false notice is liable for any resulting damages.

13. Class Action Waiver

13.1. Any dispute arising from this Agreement shall be considered individually with respect to a specific User. The User may not bring claims as a participant in a class action, as a representative of a group of persons, or in any other collective proceeding, to the fullest extent permitted by applicable law.

14. Governing Law and Dispute Resolution

14.1. All disputes and disagreements between the User and the Administration are subject to pre-litigation settlement through negotiations within 30 days from the date of a written request from one party to the other.

15. Final Provisions

15.1. This Agreement, together with the Privacy Policy and the Cookie Policy, constitutes the entire agreement between the User and the Administration regarding use of the Site.

15.2. If any provision of this Agreement is found invalid or unenforceable, this does not affect the validity of the remaining provisions.

15.3. The Administration’s failure to act on a User’s breach of any provision of this Agreement does not constitute a waiver of the right to enforce that provision in the future.

15.4. The Administration is not liable for failure to perform its obligations caused by circumstances beyond its reasonable control (force majeure), including technical failures, actions of third parties, or actions of government authorities.

15.5. This Agreement constitutes a public offer. Acceptance of its terms is deemed to occur through actual use of the Site and the materials posted on it.
