A Brazilian federal court has temporarily restored the betting license of operator CDA Gaming. Judge Adriana Pileggi of the 3rd panel of TRF-3 issued the ruling on November 3, suspending the effect of Provisional Measure No. 1,394/2026 as it applies to the company.
The license was issued by the Secretariat of Prizes and Bets of the Brazilian Ministry of Finance (SPA/MF) under Ordinance 255/2025 and was valid until December 31, 2029. CDA Gaming paid R$30 million for it, about $5.5 million at the Central Bank of Brazil rate on November 3 (5.4935 reais to the dollar).
The provisional measure bans the exploitation, offering, intermediation and advertising of fixed-odds betting in Brazil, both in physical outlets and online. For operators, this meant the end of their licenses, which lapsed on October 25. The termination does not entitle the operator to a refund of the grant fee it paid, and the government owes it no compensation.
The judge questioned this approach. In her view, the authorities provided no compensation to the operator, gave too little time to comply with the decision, and violated the principles of legal certainty and proportionality.
The ruling covers three of the company's brands: Casa de Apostas, Betsul and Jogo Online. The judge also ordered the restoration of the domain names and of the operational, financial and payment services needed to keep the business running. As of November 3, the brands' websites remained offline.
The measure is temporary. The court authorization applies exclusively to CDA Gaming and does not amount to a general opening of the market. The provisional measure remains in force, and its constitutionality is under review by the Supreme Federal Court.
Two events will be decisive from here. In Congress, the measure will start blocking the agenda on November 9. The same day, November 3, Supreme Court Justice Luiz Fux held a public hearing in case ADI 8027 against this measure. The fate of CDA Gaming's license will be determined by the final ruling on its lawsuit: the court authorization will remain valid until the merits of the mandado de segurança filed by CDA Gaming are decided or until a new court decision is issued.
