Brazil's betting ban under Provisional Measure 1394 moves to Supreme Court and Congress

Provisional Measure No. 1394 of 2026, which banned fixed-odds betting in Brazil, is now being challenged at the Supreme Federal Court (STF) and debated in the National Congress. The Congress website's entry for the measure and industry reports after the October 25 elections confirm this.

According to the MP 1394 record, the measure comes from the president and bans the organization, offering, intermediation and advertising of such bets, including sports and online games. It ends existing permits after 30 days, requires operators to return player balances and winnings, and prohibits advertising, sponsorship and related payments. It provides for blocking websites and apps, joint oversight by agencies, and penalties for violators.

Industry organizations and football clubs have filed lawsuits against the measure at the court. Justice Luís Fux, the case rapporteur, reportedly promised a ruling after the election process ends. If the STF overturns the measure, the cancellation of licenses will lose its force.

In Congress, a joint committee is reviewing the measure: 12 senators and 13 deputies have been appointed as full members, and each chamber should have 26 in total. No chair or rapporteur has been named, and the committee has not been formed. The deadline expires November 25, with a possible extension of 60 more days. From November 9, the chambers' agendas are blocked until a vote on the measure.

In Congress, according to available information, lawmakers are discussing a version that would return the market only for sports betting, without online casinos. Whether this would require new license applications has not been decided.
