Brazil's president issued provisional measure No. 1.394 on September 25, 2026. It bans the organization, offering, intermediation and advertising of fixed-odds betting lotteries across the country. Existing permits issued under Law 14.790 of December 29, 2023, will expire 30 days after the measure is published.
The ban covers betting both offline and online, including operators based abroad if they accept bets from people in Brazil. It applies to bets on real sporting events and on virtual events in online games. Other types of lotteries permitted by law are not affected.
The measure also applies at the state level. Concessions, permits and authorizations issued by states and the Federal District for such lotteries will end within the same period set out in Article 4.
Thirty days from September 25 ends on October 25. The text of the measure does not name that date itself; it follows from counting the period. The transition period brings operator obligations described in Chapter III: termination and winding down of activities.
The document also creates an interagency committee to oversee the illegal organization of betting and its advertising, and amends Law 14.790. The Senate said it sets out rules for refunding players, bans advertising and sponsorship by companies, and provides blocking mechanisms.
The provisional measure took effect immediately, and Congress will now consider it. Its decision is not yet known.
