On October 9, 2026, the president of Brazil's Federal Regional Court of the 3rd Region (TRF-3) suspended an injunction that allowed Stake Brazil to operate until October 25. A court of first instance had issued the injunction a day earlier. About 31 hours passed between the electronic signatures on the two documents.
What the first-instance court decided. On October 8, Judge Cristiane Farias Rodrigues dos Santos of the 9th Federal Civil Court of São Paulo partly granted Stake's request. Until October 25, 2026, or until a new court decision, the company's authorization under Ordinance SPA/MF No. 263/2025 was preserved, and the block on the stake.bet.br domain and sanctions for operating within the ruling were suspended. The court rejected, at this stage, the request to keep the authorization until December 31, 2029.
Operations were allowed under 12 conditions. They included keeping identity and age verification, anti-money-laundering and responsible-gambling measures, keeping withdrawals available, and a ban on new promotional campaigns and acquisition bonuses.
What TRF-3 decided. TRF-3 President Luis Antonio Johonsom di Salvo, a federal appellate judge, granted the request of the federal government (União). The injunction is suspended until the final judgment in the main action or a new decision by the court's president. The TRF-3 decision was signed on October 9 at 18:59:49, and the first-instance decision on October 8 at 11:35:06.
Reasoning. The court's president agreed that the injunction causes serious harm to administrative public order and the public economy because it exempts one operator from a nationwide policy. In his assessment, this creates regulatory asymmetry and a risk of many similar lawsuits from other operators. Protection of consumers and bettors was also cited. According to 15M, Stake opposed the suspension.
Context. Provisional Measure (Medida Provisória, MP) No. 1,394/2026 bans fixed-odds betting and its advertising in Brazil. The Supreme Federal Court is reviewing the constitutionality of the MP (ADIs 8024, 8027 and 8028). The TRF-3 decision only suspends the injunction, and Stake's main action remains pending.
