Brazil proposes refunding bets placed with illegal bookmakers and holding banks liable

On October 15, bill PL 5587/2026 was submitted to Brazil's Chamber of Deputies. It proposes refunding players for bets placed with bookmakers that lack a Brazilian license, and making banks and payment organizations responsible. The bill would amend Law No. 14.790 of December 29, 2023.

The bill's title suggests it covers fixed-odds bets placed with unauthorized operators. It affects both banks and payment companies, whose liability for such payments would be written into Law No. 14.790, which governs the country's legal betting market.

The published data on the bill does not explain how claims would be filed, how the refunded amount would be calculated, or under what conditions a bank or payment organization would be liable for a payment. It also does not say when the rules would take effect if the bill is passed.

For media buyers and affiliate programs working with Brazilian traffic, this is still only a proposal, since the bill is at the very start of the legislative process. If the refund provision is adopted, pressure on the payment chains serving illegal operators will grow, and so will the risk for those connected to them. Watch for the assignment of the Chamber's committees and whether the bill is merged with other initiatives amending Law No. 14.790.
